TERMS AND CONDITIONS OF PROVIDING ELECTRONIC SERVICES ON TEAM-CLEAN.PL WEBSITE

  1. SUBJECT OF THE AGREEMENT

These General Terms and Conditions of Service (hereinafter referred to as “General Terms and Conditions”) constitute an integral part of the agreement for the provision of cleaning services (hereinafter referred to as “Agreement”) concluded between team-clean.pl and the Client.

[DEFINITIONS] For the purposes of these General Terms and Conditions, the following terms shall have the following meaning:

General Terms and Conditions – this document entitled General Terms and Conditions of Service of 20.06.2019,

Agreement – a contract for the provision of cleaning services, of which the General Terms and Conditions are an integral part, concluded between CleanTeam and the Client,

team-clean.pl – CleanTeam Marlena Buła Company with its registered office in Myszków, Traugutta 37 Street, 42-300 Myszków, entered into the Register of Entrepreneurs, National Business Registry Number: 383397584, Tax Identification Number: 5771988905,

Client – a consumer, natural person conducting business activity and legal persons who have concluded an Agreement on the provision of Services through the Website,

Business Client – a natural person conducting business activity and legal persons who have concluded the Agreement for the provision of Services through the Website,

Website – Internet portal at the address: https://team-clean.pl, which is used to conclude contracts between CleanTeam and the Client,

Private Client – a consumer who has concluded the Agreement for the provision of Services through the Website, which is not directly related to its business or professional activity,

Service – a cleaning service provided to the Client under the terms of the Agreement,

Order – the Client’s terms and conditions for the provision of Service, which along with the General Terms and Conditions constitute an integral part of the Agreement,

Housekeeper – a person who actually performs the Service for the Client.

  1. TYPES OF SERVICES

CleanTeam provides Clients with a wide range of services on the website, depending on their needs and expectations.

The price of service is specified in the Website and is payable in advance.

The price depends on the size of surface to be cleaned, scope of cleaning, choice of a single or multiple service. Prices are shown in the order form when selecting the appropriate order options. The Client may choose additional options, which are additionally paid:

window cleaning – the prices depend on the size of cleaning surface, the price is shown in the order form after entering the appropriate data,

The Service cannot be provided until the funds have been credited to CleanTeam’s bank account.

The Client has the right to change the date or time of Service up to 48 hours prior to scheduled time.

  1. CONCLUSION OF THE AGREEMENT

The Agreement is concluded in electronic form through the Website, using a web browser. The Client is not obliged to have a certified secure electronic signature. Connection security with the Website is ensured by encrypting data using SSL certificate.

A Private Client, through the Website, concludes the Agreement for the provision of Service with CleanTeam Marlena Buła with its registered office in Myszków, Traugutta 37 Street, 42-300 Myszków, entered into the Register of Entrepreneurs, National Business Registry Number: 383397584, Tax Identification Number: 5771988905.

The Business Client, through the Website, concludes the Agreement for the provision of Service with CleanTeam Marlena Buła with its registered office in Myszków, Traugutta 37 Street, 42-300 Myszków, entered into the Register of Entrepreneurs, National Business Registry Number: 383397584, Tax Identification Number: 5771988905.

When placing an order, the Client is obliged to provide truthful information. Placing an order by the Client is made in accordance with the instructions of Website.

The Client places an Order for the performance of a Service, in which shall specify:

  • type of Service,
  • date and time of performance of the Service,
  • place of performance of the Service,

If the deadline for performance of the Agreement by a Private Client is shorter than 14 days from the date of placing an Order, it is necessary for the effective conclusion of the Agreement for the Private Client to provide an appropriate statement through the Website. In such a case, after CleanTeam has performed the Service, the Client loses the right to withdraw from the Agreement.

CleanTeam shall confirm to the Client the terms and conditions of Service in the Order confirmation sent electronically. Each Service has an individual Order number assigned to it.

By placing an Order, the Client confirms that has read and accepted the General Terms and Conditions and agrees to the processing of data for the purpose of performing the service.

The Agreement is concluded for the duration of Service.

  1. TERMS AND CONDITIONS OF SERVICE PROVISION

The Housekeeper performs the Service using CleanTeam cleaning products and equipment, unless the Client has ordered cleaning products and equipment (depending on the cleaning option chosen).

The hours of Service are as follows: 8.00 am – 8.00 pm from Monday to Saturday.

Services are provided in the following cities: Częstochowa, Katowice, Cracow.

The Client undertakes to ensure safe and hygienic working conditions for Housekeeper.

In case when at the place of providing Service the Housekeeper finds that safe and hygienic working conditions are not ensured or finds that it is the object of verbal or physical assault, the provision of Service will be immediately interrupted and the Client will be charged with a contractual penalty in the amount of price of one visit, in the amount for which the Service was to be provided.

If the Client has ordered a service, but due to his reason the Service has not been provided and has not changed the time of its provision up to 48 hours before the Service, he is not entitled to a refund for the service.

  1. PAYMENTS

The Client has the right to choose one of the forms of non-cash payment for the Service:

  • payment by bank transfer.
  • credit card payment.

The payment card operator is PayU.

A Private Client shall have the right to request an invoice without VAT for the purchased Service. An electronic invoice in PDF format shall be sent to the Client’s e-mail address specified in the Order.

After placing an order, the Business Client shall receive a VAT invoice in PDF format to the e-mail address specified in the Order.

  1. COMPLAINTS

If the Client is not satisfied with the timeliness or quality of Service, he has the right to lodge a complaint within 48 hours after the completion of cleaning service. The complaint may be submitted in electronic form to the following address: clean_team@o2.pl, or in writing to the address: Traugutta 37 Street, 42-300 Myszków. The complaint should contain a statement of reasons and possibly evidence of improper performance of the Service, e.g. photos with date and time.

CleanTeam undertakes to investigate the complaint within 14 days and to notify the Client of the manner in which the complaint will be investigated.

If the complaint is accepted, CleanTeam shall again perform the service consisting in a single visit within the scope of Service claimed, at a time agreed with the Client, but not exceeding 30 days from the date of complaint consideration.

  1. LIABILITY FOR DAMAGE

CleanTeam shall not be liable for any damage to the Client’s property arising from the performance of Service by the Housekeeper.

The Client is obliged to secure the workplace in such a way that it is safe to carry out the Service.

Valuables shall be secured by the Client in a suitable place.

  1. PROTECTION OF PERSONAL DATA, PRIVACY POLICY

In relation to the performance of Service and payment by the Client it is necessary to provide personal data of the Client.

The Client’s personal data are processed in accordance with the Act of 31 August 1997 on the Protection of Personal Data (consolidated text: Journal of Laws 2015.2135 of 2015.12.16) and the Regulation of the Minister of Interior Affairs and Administration of 29 April 2004 on the documentation of personal data processing and technical and organizational conditions to be met by devices and IT systems used for personal data processing.

The administrator of the Client’s personal data is CleanTeam.

CleanTeam adopts technical and organizational measures to ensure the protection of personal data processing appropriate to the risks and categories of data to be protected.

The Client has the right to control the processing of personal data, in particular to request that the Client’s personal data be rectified or removed by CleanTeam.

At the Client’s request, CleanTeam shall inform the Client of its rights with respect to the protection of the Client’s personal data.

  1. TERMINATION OF THE AGREEMENT

The Client does not have the right to withdraw from the Agreement, but may postpone the cleaning period up to 48 hours before the ordered service.

If the Client resigns from performing a Service during its term, it is obliged to pay for the entire Service ordered, the Private Client is obliged to pay an amount adequate to the number of hours worked by the Housekeeper.

The Private Client shall not be entitled to withdraw from the Agreement if CleanTeam has performed the Service with the express consent of the Client, who was informed prior to the commencement of performance that will lose the right to withdraw from the Agreement after the performance of Service.

  1. FINAL PROVISIONS

These General Terms and Conditions shall enter into force on 20.06.2019.

CleanTeam reserves the right to amend or supplement the General Terms and Conditions. Any amendment to the General Terms and Conditions shall be effective as of the date of posting on the website. In case of Agreements concluded before the publication date of amendments to the General Terms and Conditions, the existing terms and conditions shall apply.

These General Terms and Conditions and the Agreement shall be governed by the Polish law.

In case of a dispute arising out of the legal relationship between CleanTeam and the Client, they shall settle the dispute amicably. If no agreement is reached, the dispute shall be submitted to a common court of law according to the place of performance of the Service.

The provisions of the General Terms and Conditions are of a separable nature and any of them shall be deemed null and void without prejudice to the binding force of the others.
